1. Purpose and Medical Disclaimer (CRITICAL)

FitoGramme is a B2B SaaS platform providing a “Digital Practice Upgrade” for practitioners to manage their clients. It is a technical software solution designed to make the daily lives of practitioners easier. Under no circumstances does FitoGramme provide educational training courses or medical consulting services.

  • No Medical Advice: All content, including workout plans, meal plans, and AI-generated macro estimations, is generated or managed by the practitioner using our technical tools. FitoGramme itself provides no medical advice.

  • Practitioner Responsibility: The practitioner acts as the Data Controller and is solely responsible for the accuracy of the advice, medical decisions, and health recommendations provided to their clients via the platform.

  • Assumption of Risk: Users voluntarily assume all risks associated with physical activity and dietary changes. FitoGramme is strictly a technology provider and is not liable for any injuries, health complications, or damages resulting from the use of the Service.

2. Services and User Roles

  • Practitioners/Pros: Professionals utilizing the platform are independent entities and not employees of FitoGramme. They retain full responsibility for their professional activity and client management.

  • Coach Connect: Our marketplace feature helps end-users find professionals. We provide the technical connection but do not guarantee the results of any specific coaching or practitioner relationship.

3. Payments and Subscriptions

  • Pricing Details: Subscriptions and their respective features are fully detailed on our website at fitogramme.com/pricing.

  • External Payment Gateway: All subscriptions and payments are processed securely through our payment partner in Tunisia, Flouci.

  • No In-App Purchases: Payments are not handled via the Apple App Store or Google Play Store billing systems.

  • Invoicing: Billing is handled directly by FitoGramme. All refund requests or billing disputes must be sent to hello@fitogramme.com.

4. AI Features and Transparency

  • AI Estimation: Our Service uses Artificial Intelligence as a technical aid to analyze meal logs (including Tunisian cuisine) and provide progress insights.

  • Accuracy: While we strive for high precision, AI-generated data is an estimation. Practitioners and users must exercise professional and personal judgment when utilizing AI recommendations.

5. Account Deletion and Data

In compliance with mobile platform requirements and the Tunisian organic law No. 2004-63 on personal data protection, users may delete their accounts at any time via the Settings section of the mobile app. Deletion is permanent and removes active access to all historical logs.

6. Prohibited Conduct

You agree not to post “objectionable content,” including nudity, harassment, or illegal health advice. We reserve the right to terminate accounts that violate these community standards.

7. Limitation of Liability

FitoGramme acts with a “best efforts” obligation regarding the technical availability of the platform. We shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you for the Service in the last six months.

8. Governing Law

These Terms are governed by the laws of Tunisia, specifically Law No. 2000-83 regarding electronic exchanges and commerce. Any disputes shall be settled in the competent courts of Tunisia.
